Welcome to Kote Health. These Terms of Service ("Terms") govern your access to and use of the Kote Health mobile application, website, and related services (the "Service"), operated by Recite Labs ("Kote Health," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Kote Health. By using the Service, you represent that you meet this requirement and that the information you provide is true and accurate.

Doctors must additionally hold a valid medical license in their practicing jurisdiction and complete our verification process before accessing provider features.

2. Your account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at [email protected] of any unauthorized use.
• We may suspend or terminate accounts that violate these Terms or that we believe pose a risk to other users.

3. The Service

Kote Health provides tools to:

• Track personal vital signs and health metrics.
• Store and organize medical records, medications, and allergies.
• Book appointments with verified doctors.
• Share critical health information via an Emergency QR code.
• Access general treatment guidelines.
• (For doctors) manage patients, appointments, and clinical reviews.

We may add, modify, or remove features at any time.

4. Medical disclaimer — IMPORTANT

Kote Health is not a medical device. It does not provide medical advice, diagnosis, or treatment. The information available through the Service — including treatment guidelines and vital sign alerts — is for informational purposes only and is not a substitute for professional medical judgment.

• Always consult a qualified healthcare provider for medical concerns.
• In an emergency, contact your local emergency services immediately. Do not rely on Kote Health.
• Doctors using Kote Health are independent professionals; Kote Health does not practice medicine and is not responsible for clinical decisions made by them.

5. Doctor verification

We make reasonable efforts to verify that doctors on the platform hold valid credentials. However, we do not guarantee the accuracy or current validity of any doctor's license, qualifications, or care. You are responsible for using your own judgment when choosing a provider.

6. User content

You retain ownership of the data you upload (records, vitals, notes, photos). By uploading content, you grant Kote Health a limited, worldwide, royalty-free license to host, store, process, and display your content solely to operate the Service for you and to share with the recipients you choose (e.g., your doctor).

You agree not to upload content that:

• Violates any law or third-party right.
• Contains false, misleading, or fraudulent information.
• Infringes intellectual property or privacy rights.
• Contains malware, viruses, or harmful code.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to access another user's account or data.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service or its servers.
• Scrape, harvest, or collect data from the Service without permission.
• Impersonate another person or misrepresent your credentials.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

9. Fees

Core features of Kote Health are currently free. We may introduce paid features in the future and will provide notice and pricing terms before charging.

10. Intellectual property

The Service, including all software, text, graphics, logos, and design, is owned by Recite Labs and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

"Kote Health" and the Kote Health logo are trademarks of Recite Labs. You may not use them without our written permission.

11. Termination

You may stop using the Service at any time and delete your account from within the app or by emailing [email protected].

We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOTE HEALTH AND RECITE LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50.

14. Indemnification

You agree to indemnify and hold harmless Kote Health, Recite Labs, and our affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Federal Democratic Republic of Ethiopia, without regard to its conflict-of-law rules. Disputes will be resolved in the competent courts of Addis Ababa, unless applicable consumer-protection law requires otherwise.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
